Understanding your rights: Air Serbia and EU 261
Under the rules of EU 261, you can be compensated for flight cancellations and delays as long as your flight originated from an EU member country.
Your Air Serbia flight is eligible for delay or cancellation compensation if:
- The flight is over than 3 hours late
- If Air Serbia canceled your flight and told you it was canceled less than 14 days before departure
- If you were denied boarding because of overbooking
- If you missed your connecting flight as a result of an Air Serbia delay and arrived at your destination more than 3 hours late.

Air Serbia flight cancellation compensation
You’re eligible for compensation if your flight was canceled sooner than 14 days before the date of your departureand if the canceled flight was caused by something outside of Air Serbia’s control.
On the other hand, if Air Serbia canceled your flight and gave you more than 14 days advance notice, then you won’t be eligible for compensation. However, the airline must provide you with an alternate flight or refund your ticket if you decide not to go on the trip.
What happens with seat changes?
If you get upgraded seats on your replacement flight, then you should not have to pay for the difference. BUT if your seats were downgraded on your replacement flight, then Air Serbia must compensate you for the price difference.
Replacement flights with similar arrival times
If you’re offered a replacement flight with roughly the same arrival time as your original flight and you decide not to accept it, then you could lose the right to get both compensation and a ticket refund.
In most cases, you can refuse alternative flight offers and still receive a refund in full as long as the replacement flight arrives 3 or more hours later than your initial scheduled arrival time.
What makes an Air Serbia flight eligible for compensation?
- Your flight must be within the EU.
- The flight disruption must be caused by Air Serbia and not by conditions outside the airline’s control.
What makes a flight cancellation ineligible for a refund
An Air Serbia flight cancellation will be ineligible for a refund if it was caused by extraordinary circumstances including the following:
- Weather conditions
- Operational problems
- Technical issues with the aircraft
- Natural disasters
- Political unrest
- Airport-related disruptions like an airport strike
PRO TIP: An airline strike is different from an airport strike. If Air Serbia employees go on strike, you could still be eligible for compensation.
How much time do I have to make my claim with Air Serbia?
The statute of limitations for filing compensation claims vary depending on the country where you arrived or departed. Generally, passengers have a 3 year period from the date of their flight to file a claim.

What if I cancel my Air Serbia flight? Can I get a refund?
If you decide to voluntarily cancel your scheduled flight, then you’re not entitled to a refund. Air Serbia cancellation policy is restrictive, but if you have a flexible fare, then you can reschedule your flight to a later date with minimal cost.
