Between December 2023 and January 2024, Thai Airways flight TG921 from Frankfurt to Bangkok was on-time 87% of the time according to FlightStats. This route’s flights had a 75% on-time arrival score with 12% having a delayed arrival, and 7% arriving “very” late. Another 7% of flights were shown to have arrived excessively late.

Thai Airways Flight Disruption: What Are Your Rights

Many people are surprised to discover that they have air passenger rights protected by both EU and UK law, but these laws only take effect when your Thai Airways flight departs from an EU or UK airport.

Rights for EU Passengers

If your Thai Airlines flight is departing from an EU airport, your air passenger rights are governed by EU 261 which protects you in the case of flight delay, cancellation, denied boarding from overbooked flights and other flight disruption caused by the airline.

These regulations state that you are owed compensation up to €600 for flight disruptions, but the exact amount is determined by the amount of time you are delayed and the distance you’re traveling.

Rights for UK Passengers

If your Thai Airways flight is leaving from a UK airport, then your rights are protected by UK 261. These regulations mirror the ones in the EU and provide the same protections for passengers affected by flight disruptions. Under UK law, you could receive up to £520 in compensation from Thai Airways.

If Thai Airways cancels your flight without giving you a minimum of 14 days notice, then you can claim for compensation from the airline. The exact amount will be determined by the distance you’re traveling and the amount of time you arrive after your scheduled arrival time.

The only times when you won’t receive compensation are when your flight is canceled because of situations outside the airline’s control including severe weather, a strike at the airport, or other extraordinary circumstances.

If you’re given less than 14 days notice, or worse, if your Thai Airways flight is canceled when you’re at the airport, then you’re entitled to a replacement flight to your destination or a full refund. You just can’t have both. Still, you could receive compensation in addition to a refund.

Sometimes you miss a flight because it’s overbooked. In this case, Thai Airways could be liable for compensation, particularly if you didn’t agree to relinquishing your seat. If your journey is delayed by 3 hours or more as a result, then you could also be eligible for compensation.

And, as with other kinds of flight disruptions, the amount you could receive depends on the distance of your journey and whether or not the airline is at fault for the delay. Some situations that fall within the airline’s control include scheduling issues, technical issues with the plane, and airline staffing shortages.

Also, if your delay is 2 or more hours at the airport, the airline is obliged to provide you with food and drink. If you have a delay of 5 or more hours, then you will be given the choice of a rebooked flight or a refund

If you have to wait overnight for your flight to depart, then the airline will also have to provide you with overnight hotel accommodation in addition to transport there and back.

  3. Ask the airline for food, drink, and/or hotel vouchers. You are entitled to these as well as to communication facilities if you have to wait at the airport.

  2. Avoid accepting vouchers. Be especially careful about accepting vouchers because they tend to have a very short expiry date and lots of restrictions. Most importantly, if you accept a voucher you could forfeit your right to compensation.
  3. Avoid signing waivers or other documents. Airlines can sometimes get passengers to sign forms that will limit their liability, so be very careful to read and understand everything you’re asked to sign. Also, feel free not to sign it since your rights are protected under EU and UK law.
