What Are Your Rights As An Air Transat Passenger

If you didn’t know you had rights as a passenger, you’re not alone. Fortunately, if you’re flying in Canada your rights are protected by the Air Passenger Protection agency and include refunds and compensation up to C$500 (€341) from Air Transat should your flight be cancelled or delayed. Be aware however, that you must request compensation within 1 year of your flight disruption.

If you’re flying from the EU or the UK, then your rights are protected by EU 261 and UK 261, both of which state that the airline is required to pay you up to C$850 (€600) per passenger for flight delays, cancellations, or other flight disruptions within their control. Under EU and UK Regulations, you have up to 3 years to file a request for compensation.

While the rules for flight delays and cancellations are fairly similar in all 3 regions, there are some differences. 

In Canada

If your Air Transat flight is delayed for more than 3 hours or cancelled, then the airline must give you a replacement flight so you can get to your destination as soon as possible. At the same time, you are entitled to care in the form of food and refreshments, communication, and hotel accommodation for longer wait times. Also, you might be able to get a refund in some situations.

As for compensation, Air Transat must compensate you:

  • If the flight disruption was within their control (unless safety related)
  • If you were given less than 14 days notice
  • If you were 3 or more hours late to your destination

In the EU and UK

If your flight is departing from an EU or UK airport then you can be compensated up to C$850 (€600) for Air Transat flight disruptions including flight delays, cancellations, denied boarding due to overbooking, and missed connections.

The precise amount you could receive in compensation depends on the length of your trip and how long you were delayed, but if you must be given a replacement flight or a full refund if you choose not to travel. At the same time, if Air Transat cancelled your flight and gave you more than 14 days notice, then you will not be eligible for compensation.

The first thing you should do is find out from the airline staff why the cancellation or delay happened and make careful notes of their answer. This is more important than it sounds because you’ll need as much evidence as you can muster to support your claim if you choose to file.

So on that note, the next step you should take is to begin collecting other evidence like photos of the information board showing the status of your flight and supporting documents like your boarding pass or ticket receipt. These will also be vital for your claim. You can also ask Air Transat for meal, refreshment, and/or hotel vouchers since you have a right to care. 

Pitfalls to avoid if your flight is disrupted

Be aware if Air Transat asks you to sign any documents like a waiver. If you do sign it, you could relinquish your right to compensation. Similarly, you should be especially wary if you’re offered a voucher.
