Your Rights in Case of Flight Disruption

a woman waiting in the airport because her Sky Express flight was delayed

If you encounter a flight disruption with Sky Express, it's important to be familiar with the rights you're entitled to based on your departure location:

EU Air Passenger Rights

EU261 is a pivotal framework that aims to protect the rights of air passengers in Europe. It ensures fair treatment and appropriate compensation during instances of flight disruptions.

Under EU261 law, you're eligible for compensation for various disruptions, including delayed flights, cancelled flights, and denied boarding. The amount of compensation you can receive typically depends on the duration of the delay caused by the disruption and the distance of your flight. In some cases, you can receive up to €600.

Passenger Rights in the UK

Following the UK's departure from the EU, it implemented its own set of air passenger rights known as the UK261 passenger rights law. These regulations mirror the provisions of EU261, providing comparable protections for you, as a passenger, when travelling on UK-based airlines or departing from UK airports.

Similar to EU261, UK261 covers various flight disruptions, including cancellations, delays, denied boarding, and missed connection flights. The compensation amount under UK261 is determined by the duration of the delay and the distance of your flight. In most cases, the maximum compensation you can claim is £520.

What to Do in Case of Flight Disruption

If you're travelling with Sky Express and encounter a disruption, such as a cancelled flight, a delayed flight, or an overbooked flight, it's worth taking the following steps to streamline your compensation claim:

  1. Contact Sky Express: Reach out to the dedicated representatives of Sky Express, for instance, at their customer service desk at the airport or through their dedicated customer care call centre. Initiate a conversation to understand why the disruption has taken place and request written confirmation to maintain a transparent record of the circumstances.
  2. Keep related documentation: Safeguard your travel documents, including boarding passes, tickets, and relevant receipts. These documents can be important bits of proof when it comes to bolstering your Sky Express compensation claim. Additionally, keep a record of any written or digital communication exchanged with the airline regarding the flight disruption.
  3. Make sure the airline meets your basic needs: If you’re facing a flight disruption and find yourself stranded at an airport for an extended period, Sky Express has an obligation to meet your basic needs. This includes providing assistance with meals, drinks, communication facilities, and lodging if required.
  4. Use AirAdvisor's compensation calculator: Take advantage of AirAdvisor's user-friendly compensation calculator, specifically designed to assist you in navigating the claim process and determining your eligibility for compensation from Sky Express. This convenient tool allows you to swiftly assess the potential compensation you may be entitled to, considering the specific details of your flight disruption.

By following these steps and using the resources available to you, such as AirAdvisor's Compensation Calculator, you can ensure a smoother and more efficient process when seeking compensation for flight disruptions with Sky Express.

Things to Avoid

When seeking maximum compensation for flight disruptions with Sky Express, it's important to take the right steps. However, it's equally crucial to avoid certain actions that may hinder your compensation claim. Here are some things to avoid when experiencing flight disruptions:

Accepting Travel Vouchers

It's advisable to refrain from accepting travel vouchers as compensation. While airlines may offer vouchers, they often come with limitations, such as restricted usability, potential devaluation over time, and the inability to obtain a cash refund. Accepting vouchers may also pose a risk, as you might not be able to use them within the specified time frame. Opting for cash compensation instead helps protect your consumer rights and maintains your ability to make a claim or take legal action if required.

Hastily Signing Agreements

Avoid signing agreements without careful review, as doing so may inadvertently waive your rights or lead to accepting inadequate compensation. It’s essential to allocate time to fully read and understand the terms and conditions, consult applicable regulations, and seek professional advice. This approach can safeguard your right to a fair compensation outcome, as it adequately equips you to make an informed decision.

Accepting the First Proposal

Similar to hastily signing agreements, accepting the first proposal that comes your way may result in settling for a resolution that falls short of what you're entitled to under applicable regulations. For instance, while you may be eligible for financial compensation up to a certain amount, the airline's initial offer may be significantly lower. Stay diligent, be aware of your rights, and be open to exploring all your options to ensure you get the compensation you’re entitled to.

Flight Delay Compensation Rights

In order to be eligible for compensation in line with the applicable regulations for a delayed Sky Express flight, certain criteria must be met. You may be entitled to Sky Express flight delay compensation if the delay exceeds 3 hours and the cause of the delay is within the airline's control, such as technical issues or mismanagement of schedules.

The compensation amount for your delayed Sky Express flight is determined based on the distance of the flight. Here are the corresponding compensation amounts:

  • Flights less than 1,500km: Up to £220
  • Flights between 1,500km and 3,500km: Up to £350
  • Flights over 3,500km: Up to £520

Flight Cancellation Compensation Rights

In addition to Sky Express's delayed flight compensation, you have the right to claim compensation under the applicable regulations if the airline cancels your flight without providing a minimum of 14-day notice.

It's important to note that Sky Express flight cancellation compensation typically doesn’t apply to circumstances beyond the airline's control, such as severe weather conditions. What you may receive in compensation in case your flight is cancelled can vary, as with delayed flights:

  • Flights travelling less than 1,500km: Up to £220
  • Flights travelling between 1,500km and 3,500km: Up to £350
  • Flights travelling over 3,500km: Up to £520

If your flight was delayed, canceled or overbooked within the last 3 years, you could be eligible for up to €600 in compensation.Check Your Flight

Airline Refund

According to both EU261 and UK261, you're entitled to a full airline ticket refund in specific circumstances outlined by the legislation. These include instances where Sky Express cancels your scheduled flight without giving you at least two weeks' notice or if you experience a flight delay exceeding 5 hours.

Additionally, if you're denied boarding due to overbooking or operational reasons within the airline's control, you may be eligible for a refund. In such cases, you may also have the opportunity to claim monetary compensation based on the flight distance and duration of the delay.

Denied Boarding Compensation Rights

In the event of denied boarding, you have a right to Sky Express denied boarding compensation under the regulations. Denied boarding often occurs when flights are overbooked, resulting in a lack of available seats despite having a valid ticket. If you did not voluntarily give up your seat or contribute to the denied boarding through your own actions, you may have the right to seek financial compensation.

The amounts you can receive in compensation for denied boarding with Sky Express are as follows:

  • Flights going less than 1,500km: Up to £220
  • Flights going between 1,500km and 3,500km: Up to £350
  • Flights going over 3,500km: Up to £520

Missed Connection Compensation Rights

Under the regulations, you’re entitled to Sky Express’s missed connection compensation if a delay or cancellation of the initial flight within the same reservation causes you to miss your connection. If the disruption leads to a delay of 3 hours or more to your final destination, you have the right to seek compensation for the missed connection.

To be eligible for compensation if you missed your flight, the missed flight must be a direct consequence of a Sky Express delay or cancellation. The potential compensation amounts for missed connections with Sky Express are:

  • Flights less than 1,500km: Up to £220
  • Flights between 1,500km and 3,500km: Up to £350
  • Flights over 3,500km: Up to £520

Extraordinary Circumstances

When it comes to flight disruptions, there are exceptional events or conditions known as extraordinary circumstances that may exempt airlines like Sky Express from paying compensation. These circumstances are typically beyond the airline's control and fall outside of their regular operations. It's important to be aware of some examples of such extraordinary circumstances that may affect compensation rights:

Unpredictable weather conditions: Severe weather events such as hurricanes, snowstorms, or volcanic eruptions that pose significant risks to flight operations and passenger safety.

Air traffic control limitations: Restrictions imposed by air traffic control authorities due to security issues, strikes, or natural disasters that lead to airspace closures or traffic.

Political or civil issues: Instances that involve political unrest, civil disturbances, or acts of terrorism that may jeopardise the safe operation of flights.

Security threats: Genuine security risks or breaches that necessitate flight cancellations or diversions to ensure passenger well-being.

It's worth noting that Sky Express or any other airline generally bears the responsibility of proving the occurrence of extraordinary circumstances. They must demonstrate that the disruption was caused by factors beyond their control and that they took all reasonable measures to minimise the impact on passengers.

If you have concerns about whether the circumstances qualify as extraordinary or believe that the airline is incorrectly invoking this exemption, seeking further advice or consulting legal experts is recommended to help you understand and enforce the rights and options available to you.
