If your flight was cancelled but the airline did not inform you about this 14 days prior to the originally planned time of departure, then you have a right to flight compensation in the amount of up to EUR 600 ($700). The cancellation means the non-operation of a flight which was previously planned and on which at least one place was reserved.
Passengers have rights to the following compensation unless the airline has notified the traveller in advance and offered alternative arrangements as described below:
Apart from the compensation for a cancelled flight, an aggrieved passenger is entitled also to the following:
1) assistance to an aggrieved passenger providing the following (at airline’s cost):
✓ reimbursement of ticket full cost; or
✓ a return flight to the first port of departure (at the earliest opportunity); or
✓ re-routing at comparable transport conditions;
✓ coverage of the cost of transferring the passenger from that alternative airport either (i) to that for which the booking was made or (ii) to another close-by destination agreed with the passenger;
2) offer and ensure to an aggrieved passenger free of charge:
✓ meals and refreshments (in a reasonable relation to the waiting time);
✓ hotel accommodation (if necessary);
✓ ground transportation between the airport and place of accommodation (hotel or other);
✓ 2 telephone calls, telex, fax messages or e-mails.
Three air passengers, Olivia, Ivan and Carlos, are to take a United Airlines flight from Paris (France) to New York (USA). But the flight is cancelled and passengers are offered an alternative flight that will arrive to New York 3 hours later from the original schedule. The flight distance between New York and Paris is 5 849 km.
Olivia agrees to the alternative flight, she arrives to New York and receives her EUR 300 of flight compensation.
Carlos also agrees to the alternative flight, but his final destination is Mexico City and he only has layover in New York. So his delay in Mexico City is 5 hours so he receives EUR 600 in compensation from United Airlines.
Ivan rejected the alternative flight and stayed in Paris. So he also receives EUR 600 in compensation.
When can Airline be excused from payment of compensation?
A passenger does NOT have a right to compensation for a cancelled flight in the following cases:
✓ he is informed of cancellation at least 2 weeks before the scheduled time of departure; or
✓ he is informed of cancellation between 2 weeks and 7 days before the scheduled time of departure and is offered re-routing, allowing him to depart no more than 2 hours before the scheduled time of departure and to reach his final destination less than 4 hours after the scheduled time of arrival; or
✓ he is informed of cancellation less than 7 days before the scheduled time of departure and is offered re-routing, allowing him to depart no more than 1 hour before the scheduled time of departure and to reach his final destination less than 2 hours after the scheduled time of arrival.
