When you travel with Delta Airlines, your checked baggage is covered by clear policies from the airline and backed by the U.S. Department of Transportation (DOT). These rules determine what happens if your luggage is delayed, damaged, or lost, and they set strict timelines for reporting and claiming compensation. If your baggage is mishandled after a Delta flight, these steps help you to get your bags back and get reimbursed or compensated.

Your Baggage Rights with Delta

Your baggage rights depend on where you were flying.

Ondomestic flights within the United States, the U.S. Department of Transportation sets strict liability rules through 14 CFR Part 254. These regulations require Delta to compensate you for damaged, delayed, or lost baggage up to $4,700 per passenger. 

On international flights, Delta’s obligations come from the Montreal Convention, an international treaty that most major carriers, including Delta, must abide by. This agreement strengthens your rights by making airlines automatically liable for baggage delays, damage, or loss up to roughly $2,080 per passenger, unless they can prove they took all reasonable measures to prevent it.

Your Rights as a Passenger

If you’re a Delta Airlines passenger, you have certain rights that not only cover delayed flights but delayed baggage as well. In fact, the US Department of Transportation has made it a requirement for airlines to provide compensation for lost and damaged baggage on flights within the U.S.

If your baggage is mishandled internationally, the Montreal Convention and the Warsaw Convention cover your passenger rights, including how much you can be compensated for baggage mishandling.

If Delta Delays Your Baggage

When your checked bag doesn’t show up on the carousel, you must report the problem immediately at the Delta Baggage Service Office. The staff there will take your information, create a baggage report, known as a Property Irregularity Report (PIR), and issue a PIR or file reference number. You can use this to track your belongings, and you’ll also need it for any claim that follows.

If your bag is located within 5 days, Delta will arrange delivery to the address you provided in the PIR. 

If 6 days pass without news about your luggage, Delta states that you should submit a Property Loss Claim online and reference the PIR number from your initial report.

Getting Reimbursed for Extra Expenses

If you’ve had to buy clothes, toiletries, or other essentials while waiting for your baggage, you can file an Out-of-Pocket Expense Claim against Delta. Be sure to attach itemised receipts for everything because without them, your reimbursement claim may be denied.

The U.S. DOT requires all U.S. airlines, including Delta, to reimburse passengers for reasonable, verifiable, actual incidental expenses resulting from baggage delays. Airlines are not allowed to impose arbitrary spending limits or deny claims simply because the bag was eventually returned. The key, however, is that your expenses must be well documented and reasonable (no designer purchases).

If Delta Loses Your Baggage

If your suitcase hasn’t been found within 21 days, Delta considers it lost. At that point, the airline will contact you to discuss settlement and compensation. So, be sure you get all your receipts and travel paperwork organized because you’ll need to provide proof of the bag’s contents.

Delta must also refund any checked baggage fees you paid if your bag is lost or delayed. This refund is separate from compensation and should be processed automatically once the airline confirms your claim.

If Delta Damages Your Baggage

According to Delta’s policy, if your suitcase is damaged during a flight, you should go straight to the Delta Baggage Service Office (BSO) before leaving the airport. A staff member will inspect the damage and help you file a PIR. At that point, Delta can either repair your bag or replace it, depending on the extent of the damage and the availability of parts or similar suitcase models.

For domestic travel, you must report damage within 6 hours of arrival, a rule updated in October 2025 (previously 24 hours). 

For international flights, the time limit is 7 days from the date of arrival. The airline will give you a PIR or file reference number at the BSO, which you’ll need to start your official claim online through Delta’s “Damaged Bag Claim” portal. When you submit this, include supporting documents such as photos and receipts for any repairs or replacement purchases.

It’s worth noting that Delta will not compensate for normal wear and tear, things like scuffed corners, scratches, or small dents caused by handling are excluded. However, if zippers, handles, or wheels are broken due to mishandling, Delta’s liability applies.

If the Transportation Security Administration (TSA) opened your bag for inspection and you suspect it was damaged during screening, the airline directs passengers to contact the TSA directly at 866-289-9673.

Which Delta Routes Have the Most Baggage Problems

Delta and the US DOT don’t publish route-by-route baggage-handling breakdowns, so there is no official ranking of “worst Delta routes”. However, industry data shows that baggage mishandling tends to spike during transfers at very large hub airports, especially for airlines with massive connecting-flight operations like Delta.

This means that you have a greater chance of your baggage being mishandled on itineraries that involve a connection through a major Delta hub like:

  • Atlanta (ATL), 
  • Detroit (DTW), 
  • Minneapolis–St Paul (MSP), 
  • New York JFK (JFK) or 
  • Salt Lake City (SLC). 

Bags are more likely to go astray when they have to be transferred between flights in a hurry.

In other words, if you’re flying Delta on a long-haul or multi-leg trip that connects at a big hub, keep essentials in your carry-on, take a photo of your bag and tag, and be ready to claim if your luggage doesn’t arrive when you do.

How to File a Baggage Claim with Delta

Once you’re home and if you reported your baggage problem, go to Delta’s baggage claim portal and select the appropriate form:

  • Damaged Bag Claim for physical damage
  • Out-of-Pocket Expense Claim for temporary essentials
  • Property Loss Claim if your bag hasn’t been found after several days

Then, attach all your supporting documents, including receipts, photos, and your baggage tag. Delta typically reviews claims within a few weeks and will contact you about settlement or reimbursement.

If you don’t receive a response or believe your claim was handled unfairly, you can escalate it through Delta Customer Care, but remember to keep all written correspondence. If the airline refuses your claim or ignores you, you can file a formal complaint with the U.S. Department of Transportation’s Aviation Consumer Protection Division, but filing a complaint doesn’t mean you’ll get what you’re owed from the airline.
