EVA Air Passenger Rights

Even though EVA is based in Taiwan, when you travel with them to the EU or UK, you may still be covered by the airline regulations in those areas. Here’s how it works. If your EVA flight is departing from an EU or UK airport, then you are covered in the case of flight delays, cancellations, and denied boarding.

European Union Regulation 261/2004 describes airlines’ responsibilities to passengers. All 27 EU states are subject to its rules including Iceland, Switzerland, Norway, French Guiana, Martinique, Mayotte, Guadeloupe, La Reunion, Saint Martin, Azores, Madeira, and the Canary Islands. The UK has a nearly identical set of airline regulations titled UK261 that offers passengers who depart from any UK airport protections in the case of delays, cancellations, and denied boarding.

EVA Air Delayed Flight Compensation

Between February 26 and March 26, 2024, Airportia states that EVA had 9,734 flights. Of these, 25% were delayed by at least 15 minutes.

Flight delay compensation is an entitlement you will be eligible to receive if your flight is delayed by 3 or more hours. You should be provided with meals, refreshments, access to communication and even overnight accommodation if your delay extends until the next day. If EVA is at fault for the delay, then you might also be able to receive cash compensation that’s calculated based on the length of your delay and the distance of your flight.

During the same time period mentioned above, EVA Air had no cancellations.

There will be times when EVA will have to cancel flights for one reason or another. If they do it for a reason that is within their control, like an airline strike, or if they give you less than 14 days advance notice, then you caused by extraordinary circumstances, EVA is still supposed to provide you with 3 free emails, calls, or FAXes plus food and drink in certain situations.

Speaking of airline strikes, in January of this year, EVA Air faced a pilot strike. Focus Taiwan reported that the airline planned to, “help passengers get a refund or reschedule their flights without being charged”. So, even if you’re outside the EU or UK, you can sometimes get due compensation when the airline is responsible for any ensuing disruptions.

If EVA cancels your flight with less than a two weeks notice, you should be offered a rebooked flight or a refund if you choose to end your travel. As part of the refund, EVA must also pay for any unused parts of your trip as well as a free flight back to where you originated. 

On the other hand, if you chose a rebooking and your replacement flight causes you to wait at the airport, then you will be able to claim care compensation in the form of meals, refreshments, free accommodation for flights leaving the next day, and transportation to your hotel.

Cash compensation enters the picture if EVA Air is to blame for the flight disruption, the amount of which is calculated by your flight distance and delay duration.

EVA Air Refund Policy

According to EU/UK261, EVA must refund your ticket if they cancel your flight sooner than 2-weeks before departure, or if you have a very long delay of 5 hours or more. Likewise, if you are denied boarding because of overbooking, you might be eligible for a refund.

Denied Boarding & Missed Connections 

Occasionally, EVA might overbook flights to ensure that they are flying a full aircraft. The practice helps airlines mitigate the expense of flying a partially full plane. The trouble is, when all passengers check in and show up on time, there aren’t enough seats to accommodate everyone. Because of this, some passengers may be denied boarding. If this happens to you and it isn’t because of unruly behaviour or other reasons within your control, then you are entitled to rebooking, a refund, and compensation from EVA for the inconvenience.

If you happen to miss a connecting flight after an EVA delay or cancellation, you could be eligible for compensation particularly if you arrive more than 3 hours late to your final stop.

Things to Avoid

Don’t be surprised if EVA offers you a voucher following a flight disruption. While these are common offerings, it’s important to approach these offers with caution. In most cases, vouchers will expire before you use them because of short expiry dates, plus they come with a laundry list of restrictions. Most importantly, accepting one, or signing any documents you don’t completely comprehend, may negate your right to cash compensation. So, whatever you do, tread carefully.

Extraordinary Circumstances

So much depends on whether EVA was to blame for your flight delay or cancellation, and this usually boils down to  "extraordinary circumstances". If EVA can prove that the flight disruptions were caused by circumstances beyond their control, then they are exempt from paying you financial compensation. Some instances that fall under the extraordinary circumstances category include dangerously severe weather, restrictions imposed by air traffic control, airport strikes, civil unrest, and security threats to name a few.

BR68 from london to taipei on Aug 6. someone called me on Jul 31 afternoon told me the flight was cancelled and i need to rebook the flight myself. the refund will take up to 6 weeks. no one helped to rebook the flight

our flight was apparently cancelled due to heathrow cancelling flights because of staff shortages, we was not informed at all by our travel agent, we found out by friends who were also on this flight
