Your Passenger Rights

Because Tarom is based in Romania, your passenger rights are protected by the regulations found in European Union Regulations EU261. UK261 Regulation is nearly identical because after Brexit, the UK decided to implement its own air passenger rights regulations.

These Regulations exist so that passengers can be compensated for the trouble and inconvenience that results from flight disruptions. So, any time you have a Tarom flight that departs from or arrives at an EU or UK airport, you will be protected by these rules no matter where you live or your country of origin.

Based on the EU and UK laws, when you have a flight that is cancelled, delayed, oversold, or if you miss a connecting flight, then you are entitled to:

  • Care and assistance (meals, refreshments, access to communication)
  • Cash compensation
  • Alternate flights
  • Refunds

Tarom Delayed Flights

You’re looking forward to a seamless day of travel, and then you find out you have a flight delay. If you’re faced with waiting 2 or more hours until departure, you can at least enjoy a meal and refreshments plus free access to communication for your trouble thanks to the requirements of EU and UK law.

You can also get cash compensation, but this will be based on how long you were late arriving at your final destination. If you arrive 3 or more hours beyond your scheduled arrival time, then Tarom is required to pay you if they are at fault for the flight disruption.

When your Tarom flight delays last 5 hours or more, then you should be given the choice of a full refund or a rebooking plus cash compensation when the carrier is at fault. The following table illustrates this.

Length of Delay

Compensation & Entitlements

2+ hour delays

Meals, refreshments, and access to communication

3+ hour delays

Cash compensation if the airline is at fault

5+ hour delays

Option of rebooking or refund + potential cash compensation

Tarom Cancelled Flights

So, what happens if your flight is cancelled? Well, it depends on when you were notified.  When you're given at least 14-days notice, you will be entitled to a rebooked flight at no extra charge or a refund but not financial compensation.

On the other hand, if you are given less than 14-days notice, Tarom is required to provide you with the following:

  • Rebooked flight or
  • Cash refund
  • Care and assistance (for delays at the airport that last 2 hours or more)
  • Overnight hotel accommodation and transport for delays that require you to wait until the next day
  • Cash compensation if the disruptions was not due to extraordinary events

Tarom Cancelled Flights

Involuntary Denied Boarding & Missed Connections

Tarom and other airlines will sometimes oversell flights to ensure that they have a fully booked aircraft. When flights are oversold and you’re denied boarding, the carrier is required to provide you with:

  • A replacement flight or
  • A refund and
  • Cash compensation

If you were denied boarding because of unruly behaviour or you didn’t arrive at the gate on time or with the correct documentation, then you will not be eligible for compensation.

Your passenger rights also protect you in the case of missed connections. If your earlier flights were disrupted and you missed your connection as a result, then Tarom should provide you with an alternate flight either to your next connecting point or your final destination. You can also get cash compensation based on the length of your delay at your final stop.

TAROM Flight Refund policy

A flight compensation and a refund are two different things. Regulations allow you to receive both: a cancellation refund and compensation.

In case of a cancellation, an airline will try to re-book you on the similar flight, but if that becomes impossible, a cancellation refund will be a full cash refund. Generally, your claim would succeed, providing there were no extraordinary circumstances beyond airline control.

If TAROM cancels your flight to extraordinary circumstances (such as Covid travel restrictions or a serious illness) and you were offered no replacement flight, you can obtain a ticket refund in full, since your flights booked were not available.

Types of ticket refunds: A full refund must be in cash or credit. Vouchers are allowed only if you specifically agree to it. We do not recommend accepting vouchers due to short expiry dates and potential restrictions on redemption.

warning

Note: If TAROM offers a replacement flight with approximately the same arrival time and you decide not to take it, there is a possibility of you losing the right to get both compensation and a ticket refund.

tip

Rule of thumb: you can generally reject alternative flights and receive a refund in full, if a new replacement flight arrives 3+ hours later from your initial scheduled arrival time.

Extraordinary Circumstances

Tarom is exempt from paying you compensation in cash when extraordinary circumstances are to blame for the flight disruption. So, if your delay or cancellation was caused by the following situations, you won’t be eligible for cash compensation, but you should still be offered an alternate flight or a refund.

Try to find out what caused your flight disruptions because this information will help support your case when you file a compensation claim.

If you need help, you can let AirAdvisor take care of your compensation claim for you. Our team of legal experts can find out what caused your flight disruption, file your claim, and follow up with the airline so you get the full amount that you’re owed.

April 2, 2024, 6:05 pm

I had today (2 april) a flight from Amsterdam to Bucharest (flight number: RO364). at the airport the lady told me that my name was not in the passenger list. I called supersaver, which I bought my ticket from and they told me that they sent an email on 12 march with information that the flight was moved to 4 april. but I never saw that email or never accpetated that email. then I called Tarom the airlines. to ask them if I still can fly today. but they told me that my (transfer) flight from Bucharest to Cairo was cancelled anyways. so I would like a compensation. because this was never clear to me. and the airlines moved my flight without my accpetance. because of this I lost money of the taxi.
