LATAM Air Passenger Rights
You might not think you have air passenger rights for the EU and UK on a South American airline, but as long as your flight departs from a UK airport, your rights will be protected by the regulation UK26. Similarly, if you have a LATAM flight that departs from an airport in an EU member state or territory, then you will be protected by the EU regulations in EU26. These two sets of regulations are very similar and protect you in the case of cancellations, delays, denied boarding, and missed connections.
Furthermore, the rules state that LATAM must help you get to wherever you’re going, and they must provide certain care and assistance as well as financial compensation should your travel be disrupted. The following table explains this in more detail.

LATAM Delayed Flights
Flight delays are not especially commonplace for LATAM, but they are a regular part of air travel these days. Here’s what you’re entitled to from the airline if you are delayed for at least 2 hours.
2 hour delays (or longer): You must be given access to communication (2 phone calls, emails, etc free of charge) and food and refreshment. If you’re not given vouchers, ask them to give you one or keep your receipts if LATAM doesn’t cover the cost of these items.
3 hours or more: Delays of at least 3 hours are subject to cash compensation provided no extraordinary circumstances like air traffic control problems caused the delay.
5 hours or more: When you’re delayed for this length of time, EU and UK law requires the carrier to give you the option of an alternate booking or a full ticket refund. Remember, you will also be entitled to cash compensation on top of this if the delay was within LATAM’s control.
LATAM Cancelled Flights
Cancelled flights can occur for any number of reasons, but under the protections of EU and UK law, you can receive some help as well as compensation for the trouble and inconvenience they cause.
Flights cancelled more than 2 weeks ahead of departure are not eligible for monetary compensation, but as a passenger, you are entitled to a rebooking at no extra cost or a refund if you decide to scrap your plans.
Flights cancelled less than 2 weeks ahead of departure are eligible for rebooking or refund, as well as cash compensation if LATAM is to blame for the disruption. When you have a last minute cancellation at the airport, then you can also expect a rebooking or a refund as well as care and assistance if you have to wait for 2 or more hours for your new flight to board.
Wherever your rebooked flight is scheduled to leave much later, like the following day, passengers should be given free overnight hotel accommodation and transportation there and back.
Again, you can be compensated in cash if you arrive 3 or more hours late at your final destination as long as LATAM is at fault.

Denied Boarding & Missed Connections
Oh the dreaded scenario of involuntary denied boarding! If this happens to you because your LATAM flight was oversold, then you should be offered a rebooked flight or a refund as well as cash compensation. This only applies to denied boarding as a result of overbooked flights and not for other kinds of situations like having to use another aircraft or unruly behaviour.
As with delays and cancellations, you can also expect to get care and assistance if you’re delayed 2 or more hours until your new flight leaves.
Another nightmare happens when you miss a connecting flight. The regulations in the EU and UK say that when this happens because an earlier flight on the same booking was disrupted - then you are eligible for compensation.
