Thai Airways Flight Disruption: What Are Your Rights

Many people are surprised to discover that they have air passenger rights protected by both EU and UK law, but these laws only take effect when your Thai Airways flight departs from an EU or UK airport.

Rights for EU Passengers

If your Thai Airlines flight is departing from an EU airport, your air passenger rights are governed by EU 261 which protects you in the case of flight delay, cancellation, denied boarding from overbooked flights and other flight disruption caused by the airline.

These regulations state that you are owed compensation up to €600 for flight disruptions, but the exact amount is determined by the amount of time you are delayed and the distance you’re travelling.

Rights for UK Passengers

If your Thai Airways flight is leaving from a UK airport, then your rights are protected by UK 261. These regulations mirror the ones in the EU and provide the same protections for passengers affected by flight disruptions. Under UK law, you could receive up to £520 in compensation from Thai Airways.

Has your flight been cancelled, delayed, or overbooked in the last 3 years? If so, you could be eligible for up to €600. Check to see if your flight is eligible.Check eligibility

Thai Airways Cancelled Flight Compensation

If Thai Airways cancels your flight without giving you a minimum of 14 days notice, then you can claim for compensation from the airline. The exact amount will be determined by the distance you’re travelling.

The only times when you won’t receive compensation are when your flight is cancelled because of situations outside the airline’s control including severe weather, a strike at the airport, or other extraordinary circumstances.

Thai Airways Refunds

If you’re given less than 14 days notice, or worse, if your Thai Airways flight is cancelled when you’re at the airport, then you’re entitled to a replacement flight to your destination or a full refund. You just can’t have both. Still, you could receive compensation in addition to a refund.

Thai Airways Denied Boarding & Missed Connection Compensation

Sometimes you miss a flight because it’s overbooked. In this case, Thai Airways could be liable for compensation, particularly if you didn’t agree to relinquishing your seat. Likewise, compensation could be owed to you if Thai Airways caused you to miss a connecting flight because of denied boarding, flight cancellation, or flight delay within the same reservation. If your journey is delayed by 3 hours or more as a result, then you could also be eligible for compensation.

Thai Airways Flight Delay Compensation

Thai Airways Flight Delay Compensation

If your Thai Airways flight is delayed, then you could also be eligible for compensation provided the delay is more than 3 hours long. And, as with other kinds of flight disruptions, the amount you could receive depends on the distance of your journey and whether or not the airline is at fault for the delay. Some situations that fall within the airline’s control include scheduling issues, technical issues with the plane, and airline staffing shortages.

How Distance Affects Compensation

The following table illustrates how much you could be compensated for flights of different distances as per the rules of EU 261 and UK 261.

Flights between 1,500 km and 3,500 km

Steps to Take If Your Thai Airways Flight is Disrupted

Regardless of whether you had a flight cancellation, delay, denied boarding, or a missed connection, you should take certain steps to make sure your passenger rights are protected and to gather information to support the claims process later.

  1. Ask Thai Airways staff what caused the disruption and keep a record of their response.
  2. Organise your supporting documents: Boarding passes, responses from the airline about the flight disruption, photos of the arrival and departures board, and other evidence to support your claim.
  3. Ask the airline for food, drink, and/or hotel vouchers. You are entitled to these as well as to communication facilities if you have to wait at the airport.
  4. Use AirAdvisor’s compensation calculator to determine if your flight qualifies for Thai Airways compensation.

If you follow these steps, you’ll be better able to handle the flight disruption and to successfully file a compensation claim with the airline.

What to Avoid If Your Thai Airways Flight is Cancelled

We’ve explained the steps you should take if your flight is delayed or cancelled, but there are a few things you should be careful to avoid.

  1. Avoid agreeing to the first offer. The airline might try to offer you very low compensation, but instead of accepting it right away, compare it to the amounts you’re entitled to based on EU and UK law. Once you determine the amount, insist that the airline pay this amount in full.
  2. Avoid accepting vouchers. Be especially careful about accepting vouchers because they tend to have a very short expiry date and lots of restrictions. Most importantly, if you accept a voucher you could forfeit your right to compensation.
  3. Avoid signing waivers or other documents. Airlines can sometimes get passengers to sign forms that will limit their liability, so be very careful to read and understand everything you’re asked to sign. Also, feel free not to sign it since your rights are protected under EU and UK law.

Had to spend a night at a hotel 7miles away from the airport. Was given a sandwich, apple and water to have at night when we arrived (midnight). Originally purchased the tickets as the connection was only going to be 1.5hours but now the connection delay is 8 hours. No written confirmation at all regarding compensation as the “manager” isn’t around.
