Types of Compensations Covered by EC 261

EC 261 offers quite broad coverage and will help you in a wide range of situations. Here are the four main cases in which passengers can typically make a claim under EC Regulation 261.

  • Flight delay - you can claim delay compensation with the help of EU 261 2004 in situations where your flight was delayed for three hours or longer.
  • Flight cancellations - passengers can claim flight cancellation reimbursement if their flight was cancelled by the airline. You might also be able to get a full flight refund in this case.
  • Overbooking - you can also request compensation in situations of overbooking. This is when an airline sells too many tickets for a flight and you are denied boarding.
  • Missed connection flight - if you have a delayed flight, you might fail to arrive in time for a connection later in your journey. In this situation, passengers are also protected by EC Regulation 261.

Compensation For Vueling Cancelled Flight

Cases When You Are Not Entitled to Compensation

However, you cannot claim compensation in the following circumstances:

  • You are informed of the cancellation of the flight at least two weeks before the scheduled time of departure;
  • You are informed of the cancellation of the flight between 2 weeks and seven days before the initial time of departure and are given redirection, allowing you to leave no more than 2 hours before the scheduled time of departure and to reach the destination less than 4 hours after the scheduled time of arrival;
  • You are informed of the cancellation of the flight less than seven days before the initial time of departure and are given redirection, allowing you to leave no more than one hour before the scheduled departure time and arrive at your final destination less than 2 hours from the scheduled time of arrival.

Our initial direct flight was VY 6252 Paris-Rome, for a 5 day trip. We arrived for check-in 2 hours prior and were told we could not be issued boarding passes as the flightvwas overbooked. I had received no prior notification. We were told our options were to fly to Barcelona with a 4.5 hrs layover and the fly to Rome (arriving in the evening instead of 12 noon: we would like half a day) or find ourselves another flight. We accepted and received compensation for this flight. However, the real nightmare began in Barcelona. Our flight VY 6106 was delayed over 2 hours, then we were boarded on the aircraft and were made to wait 2 more hours, being lied to every 20 minutes, as were told by cabin crew and pilot that we would take off any minute. It was dinner time, and we were left with no water, no food, blocked in an aircraft for 2 solid hours!! Lied to every time we asked whether the aircraft was viable or whether we should disembark. After people started getting restless, the pilot announced imminent departure and under 10 minutes later, told us to disembark. It was pas 10:30 pm, the airport was empty, restaurants were closed and staff was gone! It was a ghost town and nobody accompanied the 177 passengers. We were left alone, to wander empty halls, and find our own help. It took us over 40 minutes to gather our luggage and find counters: 4 for 177 people! They told us we had to stay overnight, got us in a hotel 50km from the airport and we were automatically arranged flights to out destinations thr following day. Mine was in the afternoon: arriving in Rome in the evening: thus 2 lost days versus planned, on a 5 day stay!! I was travelling with my 2 teenage children. Shuttle service was organised for early the next day: with commute, we had under 5 hours of sleep. Service was inexistant, all flights we were put on were either late or had technical issues and never took off, we were promised vouchers we were never given, we spent a full day and a half in airports for a 2 hour direct flight reservation, during which we spent the equivalent of an additional flight ticket for overpriced airport food as only option to feed ourselves. We ended up returning home as we lost all trust in Vueling capacity to honour flights and list our vacation to return home to see family. We were devastated.
