Your Air Passenger Rights with Eastern Airways

Because Eastern Airways is based in the UK and its destinations are all either UK or EU based, your rights will be outlined in UK261 or EU261 regulations. The purpose of these rules is to protect you for flight delays, cancellations, and denied boarding and are extended to anyone who flies with Eastern Airways regardless of their citizenship or country of residence.

The regulations in the UK and EU mirror one another and set out to offer passengers cash and care compensation when certain conditions are met, but more on this in the following sections. The table below will give you a better idea of what the airline is required to provide.

Eastern Airways Flight Delay Compensation

In order to receive flight delay compensation, your delay has to be at least 3 hours long and caused by an event within Eastern Airways’ control. However, for any delay 3 hours or longer you should be offered meals, refreshments, and access to communication all free of charge.

Eastern Airways Cancellation Compensation 

When Eastern Airways cancels a flight and gives you 2 weeks prior notice, you will not be able to collect compensation. On the other hand, if they cancel your flight with fewer than 14-days notice, you have the option of a rebooked flight or a refund.

You can still get cash compensation from the airline in addition to the rebooking or refund, but once again, this will depend on whether Eastern Airways was able to prevent the cancelled flight. If they are to blame, then you could get cash compensation. If the situation causing the cancelled flight was outside their control, you won’t.

Either way, the airline must still offer you care and assistance if your rebooked flight causes you to wait for 3 hours or more or until the next day. As with flight delays, Eastern is required to provide you with meals, refreshments, communication, hotel accommodation (for overnight delays), and transport to and from the hotel.

In July 2023, Eastern Airways made the news for cancelling a flight causing passengers to pay for ground transportation to their destination. 

“A would-be passenger has criticised Eastern Airways for cancelling a flight following a two-hour delay with no explanation. The disgruntled customer was supposed to be flying from Gatwick to Newquay on Friday (July 7) but ended up needing a £600 Uber trip to get home.”

Eastern Airways responded by saying:

"Similar to all airlines and transport providers, Eastern Airways are unable to guarantee that our services will not be subject to either an unanticipated technical, operational or weather issue on the day of travel. However, whenever it is possible for us to do so, we can assure you that we will always endeavour to look at the best ways of recovering a situation and this may include rerouting and/or combining or diverting services.” (Cornwalllive.com)

Always try to discern what caused the delay of cancellation, even if that means digging deeper by asking airport staff what is causing flight disruptions. If more than one airline is affected, then chances are the problem was caused by extraordinary circumstances, otherwise it could be that the airline is to blame.

Refunds from Eastern Airways

If your flight is cancelled, EU and UK regulations state that you must be offered a full ticket refund. You are also entitled to a refund if your Eastern Airways flight is delayed longer than 5 hours. Remember, you may still be eligible for financial compensation in addition to a refund!

PRO TIP: If you’re offered a voucher in place of a refund be very careful about reading all the details and thoroughly understanding them before you accept it. You are not obligated to accept vouchers and sometimes agreeing to the terms means you will forfeit your right to compensation.

Denied Boarding & Missed Connections 

If you are denied boarding because Eastern Airways overbooked your flight, then you are also entitled to compensation, a refund, or a rebooked flight. Passengers who are denied boarding for being unruly or disruptive are not eligible for compensation.

If you miss a connecting flight because Eastern Airways delayed, overbooked, or cancelled your earlier flights, then you should be compensated financially as long as the airline is at fault and you end up arriving at your final destination 3 or more hours late. Nonetheless, you should still be offered a replacement flight, care and assistance.

I was at gatwick, waiting to check in, it was delayed, and the check in lady came out and said it was cancelled, I got a train for £60 to my final destination. I want a refund on the original price and them to pay for my replacement train plus the extra 5 hours I will arrive late.

I was waiting at Gatwick next to the check in, then the check in lady told us the plane was cancelled, I have now bought a replacement train ticket for £60 which I want refunded as well if possible.

Flight was cancelled 1630, 1hr 15mins prior to departure. I was then taken by taxi from Wick to Aberdeen which is a 5 hour drive, no allowance for food was provided, I then arrived at my hotel at 2315 which meant I missed my evening meal at the hotel. I then only got 4 hrs sleep prior to my check in for my flight the following morning which was a 0545 check-in. This was my outbound flight, I am due to return on August 25th 2022, this flight time has also been changed from my original booking time of 1640 to a departure time of 1820.
